Please carefully read the following Terms and Conditions ("Agreement") governing the rental of water equipment from Midwest Fun Stuff. These terms are designed to ensure the safety of all parties involved. By renting and using the equipment, you acknowledge and agree to comply with the following rules and guidelines:
a. Midwest Fun Stuff agrees to rent the water equipment specified in the rental agreement to the Renter for the agreed-upon rental period.
b. The Renter acknowledges that they have inspected the equipment and found it to be in good condition before accepting the rental.
The Renter will be required to have a card on file to be charged in the event of theft or that the equipment is damaged in any way that needs to be repaired or replaced.
The Renter will sign a liability agreement and a rental agreement at the time of pickup to be kept on file.
Responsibility:
a. The Renter accepts full responsibility for the safe and proper use of the equipment during the rental period.
b. The Renter agrees to abide by all applicable laws, rules, and regulations governing the use of water equipment at the rental location.
a. The Renter must have the necessary knowledge, skills, and experience to safely operate the rented equipment.
b. The Renter agrees to follow all water safety guidelines, including but not limited to wearing appropriate safety gear, such as life jackets, when required.
c. The Renter should be aware of and respect the water conditions, weather conditions, and any posted warnings or advisories.
d. The Renter should exercise caution while using the equipment and avoid risky behaviors, such as jumping or diving from the equipment.
e. The Renter agrees not to operate the equipment under the influence of alcohol, drugs, or any substances that may impair judgment or coordination.
f. The Renter must be a competent swimmer, wearing a life preserver at all times while operating rented water equipment, and capable of self-rescue in the event of an emergency.
a. The Renter agrees to handle the equipment with care, avoiding any intentional or reckless actions that could cause damage.
b. The Renter should be aware of any specific care instructions provided by Midwest Fun Stuff and follow them accordingly.
c. The Renter is responsible for any loss, theft, or damage to the equipment during the rental period, excluding normal wear and tear.
d. In the event of damage to the equipment, the Renter must notify Midwest Fun Stuff immediately and follow any instructions provided.
a. If the Renter wishes to extend the rental period, they must contact Midwest Fun Stuff prior to the agreed-upon end date and obtain approval for the extension.
b. Additional rental fees may apply for any extended period.
a. The Renter hereby releases Midwest Fun Stuff, its owners, employees, agents, and affiliates from any liability for personal injury, property damage, or any other claims arising out of the use of the rented equipment, except in cases of gross negligence or willful misconduct by Midwest Fun Stuff.
a. The Renter agrees to indemnify and hold Midwest Fun Stuff harmless from any and all claims, damages, losses, or expenses arising out of the Renter's use of the equipment, including but not limited to personal injury or property damage.
a. This Agreement shall be governed by and interpreted in accordance with the laws of Allegan County and the State of Michigan, without regard to its conflict of laws principles.
a. This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements or understandings, whether written or oral, relating to the rental of water equipment.
